Hi Sai,Thanks for your response. As per Section 93 compulsory licences operate as deed between both parties. Therefore if the Controller has not allowed for importation as a clause of the licence then the licencee cannot import the good. The only way the licencee can import the good is if the Controller allows him to do so as a term of the compulsory license OR if the Central Government issues directions under Section 90(3).Are you saying that S. 107A(2) will apply regardless of whether the act of importing is authorized by the CL?
